Whether you run an IT-services firm, a D2C brand, or a startup with a Delaware flip structure, the mechanics of filing a U.S. trademark from India follow the same core steps.
Step 1: Confirm your applicant entity
Decide whether the application should be filed under your Indian private limited company, an individual founder, or a U.S. entity — and be accurate about where the business is genuinely domiciled.
Step 2: Search for conflicts
Our preliminary search checks USPTO records for obvious conflicts. IT-services and SaaS names in particular tend to be crowded, so a detailed search can be worth the extra step.
Step 3: Describe your goods/services precisely
"Software as a service featuring [specific function]" is more defensible than a vague description, and helps determine the correct class.
Step 4: Gather supporting details
This includes your GST/Udyam registration (if applying under an Indian entity), your business address, and evidence of current or planned U.S. use.
India-domiciled applicants must be represented by a U.S.-licensed attorney before the USPTO. Simply forming a Delaware entity while operations remain in India does not, on its own, change this. See our foreign-applicant guide.
Step 5: File and pay USPTO fees
The application is filed with the USPTO fee ($350 per class) paid at that time, separate from our $150 service fee.
Step 6: Track your application
We monitor the case and flag Office Actions or other USPTO correspondence as they arise.
