What a trademark is, and how the registration process generally works.

What is a trademark?

A trademark can be a business name, brand name, logo, slogan, word, symbol, design, or a combination of these. Trademarks help identify and distinguish the goods or services of one business from those of another.

For example, if someone creates a brand called "ABC Coffee," the name may function as a trademark for coffee-related goods or services if it meets the applicable legal requirements. Trademark rights are tied to particular goods or services and to the trademark classes those goods/services fall under.

What does U.S. federal registration involve?

A U.S. federal trademark application is filed with the United States Patent and Trademark Office (USPTO) and generally requires:

  • Identifying the applicant (individual or business) and their country of domicile
  • Describing the trademark itself (word mark, logo, slogan, or a combination)
  • Identifying the specific goods and/or services the mark will be used for
  • Selecting the applicable international (Nice) class(es)
  • Providing a specimen of use, where the application is based on actual use in commerce
  • Paying the USPTO's government filing fee, which is charged per class

Foreign-domiciled applicants: if you are domiciled outside the United States, USPTO rules generally require that you be represented by a U.S.-licensed attorney.
