Do you need to file an application to use TM?
No. According to USPTO guidance, TM can be used even when no application has been filed, and even before any registration is granted. It's a way of publicly signaling "we consider this our brand" while you build your business.
Who is TM for?
TM applies specifically to marks used for goods — physical products like clothing, food items, electronics, or packaged products. If your business is service-based (consulting, IT services, education), the equivalent symbol is SM.
Does TM give you legal rights?
