Why You Should Search Before You File a Trademark
A small step that can save real money and rework.
It's tempting to skip straight to filing once you've settled on a name. But a search first — even a basic one — can save you from a much more expensive problem down the road.
What can go wrong without a search
- You file, pay the $350 per-class USPTO fee, and receive a likelihood-of-confusion refusal months later — after you've already invested in branding.
- You launch packaging, ads, and a website around a name that later needs to change entirely.
- You discover a competitor with a similar name only after a customer mentions the confusion.
What a preliminary search catches
Our basic preliminary search, included with our standard filing service, flags identical or near-identical marks already on file and obvious conflicts in closely related goods/services.
When a detailed search is worth it
For crowded categories — beauty, supplements, fintech, SaaS — a detailed search ($300) goes further, examining similar spellings, phonetic similarities, and related goods/services considerations.
No search — basic or detailed — guarantees registration or provides a legal opinion on availability. It reduces risk; it doesn't eliminate it. For a formal legal clearance opinion, consult a U.S.-licensed trademark attorney.
The bottom line
A search costs far less than rebranding after launch, or than the professional fees involved in responding to an Office Action citing a conflict you could have caught earlier.
